By utilizing our products, services, Apps, and Websites, you agree to this Privacy Policy and expressly consent to the processing of personal information according to this Privacy Policy.

      • Note that FloLogic Apps may collect your precise geolocation when you access the Websites.
  1. Information We Collect from Your Use of Our Appliances and Services
  • Information about the use and performance of our appliances, including appliance serial number, usage activity and patterns, sensor data, service history, location of the appliance and time zone, settings, internet connection. Note that in circumstances where your appliance is connected to the internet and you have not downloaded or installed the Bradford White Connect App, we may collect and process this information in deidentified form, meaning that it cannot be reasonably linked to or associated with you or any other identifiable individual. We reserve the right to retain and use all such information for any legitimate business purpose without further notice to you or your consent, unless required by law.
  • Information related to your home’s architecture and plumbing system.
  1. How We Use Information We Collect

We may process this information to:

  • Fulfill or meet the reason you provided the information. For example, if you provide your personal information to register to list your business on our Websites, we will use that information to add your information to our contractor directory. We may also save your information for these purposes.
  • Provide, offer, support, personalize, or develop, improve our Websites, Apps, appliances, products, and services.
  • Create, maintain, customize, and secure your account with us.
  • Process your requests, purchases, transactions, and payments and prevent transactional fraud.
  • Provide you with support and respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
  • Help maintain the safety, security, and integrity of our Websites, Apps, services, databases and other technology assets.
  • Test, research, analyze, and conduct product development to develop and improve our appliances, Websites, Apps, and related services.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection. Respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.
  • Communicate with you about your job application with us and evaluate your potential employment with us.
  • Send promotional messages, marketing, advertising, and other information that may be of interest to you based on your preferences.
  • Personalize, measure, and improve our advertising to you.
  • Fulfill any other use that we describe when you provide the information.
  • Note that FloLogic, Inc. processes certain App data for adherence monitoring purposes and related insurance administration.
  1. Disclosing, Sharing, and Selling Information.
  1. Disclosing Personal Information

We may disclose your personal information to a third party for a business or commercial purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and to use it only for purposes for which we disclose to them.

We disclose personal information as stated below:

  • within the Bradford White family of companies. This includes our subsidiaries, affiliates and business units. We share personal information within the Bradford White family of companies for all purposes described in this Privacy Policy.
  • with data analytics, software/IT, cybersecurity, cloud service, consultants, financial, legal, and other similar providers that support our business.
  • with contractors and installers that install and provide maintenance and service for our products.
  • with service providers that connect end consumers with local vendors.
  • with utility partnership programs if required by utility partners for participation in their programs;
  • with banks and credit card processors to the extent necessary for Company to deliver the services.
  • when we believe sharing is necessary to protect our rights, preserve safety, investigate fraud or other wrongdoing.
  • when required by law, which includes complying with any court order, law, or legal process, including responding to a government or regulatory request.
  • in connection with the sale, transfer or financing of Company’s business or its assets, including a bankruptcy proceeding or to our affiliates.
  • to enforce or apply our agreements, including for billing or collection purposes.
  • for any other purpose we disclose to you when you provide the information.
  1. Sharing Personal Information for Personalized Advertising

In this Privacy Policy, “sharing” means disclosing a consumer’s personal information to third parties for cross-context behavioral advertising. “Cross-context behavioral advertising” refers to the targeting of advertising to a consumer based on the consumer’s personal information obtained from the consumer’s activity across websites and applications, other than those with which the consumer intentionally interacts. In the preceding twelve months, Company has “shared” personal information with third parties for the purposes of personalized advertising. More specifically, FloLogic, Inc. has shared the following categories of personal information with third-party advertising partners for this purpose: IP addresses, web browser type and version, operating system information, page views, referrer URL, and device type.

  1. Selling Personal Information

In the preceding twelve months, Company has sold personal information to third parties. For example, FloLogic, Inc. has sold personal information (including information related to your use of the Apps, Websites, products, and services) to insurance carriers or home warranty providers, to monitor our products and/or your usage of our Apps and Websites. These third parties may use such information for the underwriting of property insurance policies and monitoring compliance with the terms and conditions of such policies.

Company does not sell personal information pertaining to minors under the age of 16.

  1. Information Security and Retention.

We use reasonable administrative, technical, and physical security measures to protect the personal information we retain and to help ensure that it is used in accordance with this Privacy Policy.

We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless longer retention is required by law or for auditing purposes. To determine the appropriate retention period for personal information, we consider applicable laws, the volume and nature of the personal information, its purpose, and the potential risk of harm from its unauthorized use or disclosure.

  1. Cookies and Tracking Technologies.
    1. Cookies

Our Websites and Apps may use “cookies” and other tracking technologies to gather information about your interactions. This information may include demographic data, browser type, IP address, pages visited, activities conducted on the page, and the day and time of your visit. Our Websites and Apps may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to make your experience on the Websites more personal and interactive. We do not currently honor “do not track” signals from a web site browser. Please refer to your computer browser “help” instructions for more information on cookies and other related technologies and how to manage their use. If you refuse or delete cookies, you will need to repeat the process if you use another computer or change browsers. If you refuse or delete cookies, some of the functionality of our Websites or Apps could potentially be impaired.

Some FloLogic Apps and Websites utilize third-party cookies and similar tracking technologies that are set by advertisers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Websites, including personal information about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based, behavioral advertising or other targeted content

    1. Analytics Services

    1. Web Beacons

Pages of our Websites and Apps may also contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that allow us, for example, to count users who have visited those pages. We may use this information to provide a better Website user experience, and tailor our marketing communications.

  1. Text Messaging (SMS) Communications

We may use your mobile phone number to provide you with non-marketing, transactional, or informational communications, such as appointment reminders, service updates, account alerts, how-to videos, and supporting documents. By providing your mobile number, you consent to receive these communications.

  • Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message you receive from us.
  • Help: Reply HELP for more information regarding our SMS services.
  • Data Sharing & Privacy: We value your privacy. Mobile information and opt-in data collected for SMS purposes will not be shared with, sold, or rented to third parties or affiliates for marketing or promotional purposes.
  • Costs: Message and data rates may apply. Frequency of messages varies based on your interaction with our services.
  1. Your Rights.

You have certain choices about how we use your personal information:

  • You can opt out of receiving our marketing emails and text messages. To stop receiving our promotional emails, you can follow the instructions in any promotional message you get from us. If you receive promotional text messages from us, you may opt out by replying “STOP”. Even if you opt out of getting marketing messages, we will still send you transactional messages. These include responses to your questions.
  • You can control certain location and other tracking tools. You can control certain cookies and tracking tools as discussed in Section 5 above. Keep in mind that the cookies used on our various Websites will differ and you will need to set your preferences on each website you visit. Your browser may also give you the ability to control cookies or other tracking tools. How you do so depends on the type of tool. Certain browsers can be set to reject browser cookies. Options you select and choices you make are browser, website and device specific. If you clear your cookies or your browser’s cache, you will need to set your preferences again.

To comply with your request, we may ask that you verify your identity for security purposes before we take further action. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. This supplements the information contained the Privacy Policy and applies solely to individuals who reside in the State of California.     1. Right to Access and Data Portability

    1. Right to Correct

You have the right to request that we correct inaccurate personal information, taking into account the nature of the personal information and the purposes for processing the personal information. Once we receive and confirm your verifiable consumer request, we will use commercially reasonable efforts to correct the inaccurate personal information.

    1. Right to Non-Discrimination

We will not discriminate against you for exercising any of these rights. Unless permitted by California law, we will not:

  • Deny you goods or services.
  • Provide you a different level or quality of goods or services.
  • Charge you different prices or rates for goods or services, including granting discounts or benefits, or imposing penalties.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by California law that can result in different prices, rates, or quality levels. Any permissible financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior affirmative consent, which you may revoke at any time.

In the preceding twelve months, Company has sold personal information to third parties. For example, FloLogic, Inc. has sold personal information to insurance carriers or home warranty providers, to monitor our products and/or your usage of our Apps and Websites. These third parties may use such information (including information related to your use of the Apps, Websites, products, and services) for the underwriting of property insurance policies and monitoring compliance with the terms and conditions of such policies. You have the right to opt out of the sale of your personal data.

    1. Right to Opt Out of Sharing Personal Information for Personalized Advertising

Company does not process sensitive personal information beyond what is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.

    1. Rights Under California’s “Shine the Light” Law

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits California residents that use our websites to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.

Kentucky, Maryland, Minnesota, Nebraska, Tennessee and Texas

If you are a resident of Kentucky, Maryland, Minnesota, Nebraska, Tennessee, or Texas, this supplements the information contained in the Privacy Policy and provides you additional information that applies to you under applicable data protection laws in your respective states. To exercise any of the rights described below consistent with applicable law, please follow the instructions provided in the “How to Exercise Your Rights” section of this document.

We collect information that is linked or reasonably linkable to an identifiable individual and does not include de-identified data or publicly available information (“personal information“). You have the right to confirm whether Company is processing personal information and to access this personal information. You may obtain personal information you previously provided Company in a portable and readily usable format, to the extent technically feasible.

Maryland residents have the right to obtain a list of the specific third parties to which Company has disclosed their personal information.

You have the right to correct inaccuracies in your personal information, taking into account the nature of and purposes for processing the personal information.

You have the right to delete your personal information that we maintain about you, subject to certain exceptions.

  1. Right to Appeal Consumer Rights Request Responses

In the event that your request is denied, or only fulfilled in part, and you are not satisfied with the outcome of your request, you may submit an appeal by sending an email to privacy@bradfordwhite.com with “Data Privacy Appeal” in the subject line. You may appeal Company’s refusal to take action on your consumer rights request within a reasonable time after you received Company’s decision. Within 60 days of receipt of your appeal, we will notify you via a written response about the action Company has taken or not taken. You may contact the state Attorney General if you have concerns about the result of the appeal.

  1. Right to Opt Out

In certain circumstances, we may “sell” personal information, including to insurance companies for adherence monitoring purposes. We may also use personal information obtained from or in connection with your activities across unaffiliated sites to send more targeted advertisements to you. You have the right to opt out of your personal information being processed:

  • For targeted advertising;
  • For the sale of personal information; or
  • For profiling to make decisions that produce legal or similarly significant effects.
  1. Right to Consent to the Processing of Sensitive Personal Information

You have a right to consent to the processing of your sensitive personal information, including:

  • Personal information revealing racial or ethnic origin, religious beliefs, a mental or physical health condition or diagnosis, sexuality, citizenship or immigration status,
  • Genetic or biometric data processed for the purpose of uniquely identifying an individual,
  • Personal information from a known child, or
  • Precise geolocation information.
  1. Right to Request a List of Recipients to Whom We Disclosed Personal Information

If you are a Maryland or Minnesota resident, you may also request a list of categories of third parties to which we have disclosed your personal information.

  1. Right to Request that We Cease Processing Personal Information

If you are a Maryland resident, you have the right to submit a request that we cease processing your personal information, subject to certain exceptions. If you would like to exercise this right, please submit your request following the instructions in the “How to Exercise Your Rights” section.

How To Exercise Your Rights

Depending on where you live, the rights described in this supplement may apply to you. To exercise your rights compatible with applicable law, please submit a verifiable consumer request via 1-800-523-2931 or EMAIL/Webform.

  1. Verification of Your Identity for Consumer Requests

In order for us to fulfill your requests, we must first verify your identity. We will take reasonable steps to verify your identity prior to responding to your requests. The verification steps will vary depending on the sensitivity of the personal information and whether you have an account with us. If you are emailing us, your request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected information, and describe your request in sufficient detail that allows us to properly respond to it. We cannot fulfill your request, or maybe will only be able to fulfill it partially, if we cannot verify your identity and confirm that the information relates to you.

You may designate an agent to submit a request related to your personal information on your behalf. Proof to verify your identity and the authorized agent’s authority to submit requests on your behalf are required, and if we are not able to sufficiently verify your identity or the authorized agent’s authority to act on your behalf, we may deny the request. We use commercially reasonable efforts to authenticate your identity and the authorized agent’s authority through the written documentation provided in connection with the requests. If you are a California resident, you can designate an authorized agent to make a request on your behalf only if: (1) the authorized agent is a natural person or a business entity registered with the Secretary of State of California; and (2) you sign a written declaration that you authorize the authorized agent to act on your behalf. If you use an authorized agent under California law to submit a request to exercise your rights, please have the authorized agent take the following steps in addition to the steps described above:

  • Mail a copy of your signed written declaration authorizing the authorized agent to act on your behalf; and
  • Provide any information we request in our response to your email to verify your identity. The information requested will depend on your prior interactions with us and the sensitivity of the personal information at issue.

If you provide an authorized agent with power of attorney pursuant to California Probate Code sections 4121 to 4130, it may not be necessary to perform these steps and we will respond to any request from such authorized agent in accordance with the CCPA.

If your submission of requests is excessive, repetitive, or manifestly unfounded, we may determine that the request warrants a fee, in which case we will tell you why we made that decision and provide you with a cost estimate before completing your request.

  1. Response Time

We will confirm receipt of your request within 10 days of receipt. We will aim to fulfill your request within the time allotted under applicable law, generally forty-five (45) days of its receipt. If we require more time (up to 45 days), we will inform you of the reason and extension period in writing in compliance with applicable law.

  1. Method of Response
